Notice of Amendment to Market Rules

In accordance with section 60 of the Electricity Act (New Brunswick) and Market Rule 3B.4.3, the New Brunswick System Operator (“NBSO”) publishes this Notice of the following amendments to the Market Rules.

Market Rule 3A.1, Composition of the Market Advisory Committee (MAC), is amended by the expansion of the membership of the MAC to include representation from two additional sectors:

1. Market Rule 5.3 (Forecasts and Assessments) is amended as described at Item 2008-01 of the attached document entitled Proposed Revisions to Market Rules.
2. Market Rule 6.3 (Short Term Assessment and System Planning Reporting) is amended by the addition of section 6.3.4 as described at Item 2008-02 of the above-noted attachment.
3. Market Rule 6.18 (Publication of System Information) is amended as described at Item 2008-03 of the above-noted attachment.
4. Market Rule 3.5 (Market Monitoring) is amended as described at Item 2008-05 of the above-noted attachment.

Background information and the reasoning supporting each of these amendments are provided in the above-described attachment.

These amendments were reviewed by the Market Advisory Committee (“MAC”) at a meeting held February 20, 2008. The Report of the MAC recommending adoption of these amendments was published on the NBSO website on February 21, 2008. At a meeting held February 29, 2008 the Board of Directors of the NBSO reviewed the Report of the MAC and unanimously approved the adoption of the above-described amendments.

Section 60 of the Electricity Act provides that any person may apply to the New Brunswick Energy and Utilities Board for a review of these amendments within 30 days of the publication of this notice.

These amendments take effect April 7, 2008.
