Report of the Market Advisory Committee

In accordance with Market Rule 3B.3.2, the Market Advisory Committee (MAC) hereby advises the Board of Directors of New Brunswick System Operator that the MAC has fully reviewed proposed amendments to the Market Rules, which proposals were published on the NBSO website on August 24, 2006.

The MAC further advises the Board that, at a meeting held August 28, 2006, the MAC:

1. With respect to proposed amendment #1, “Bid-Based Demand Response”, unanimously approved the proposal subject to (i) removal of any obligation on the BBDR applicant to submit an acknowledgement or consent letter from the Market Participant for the Load Facility, and (ii) replacement of any such obligation with an obligation to provide the NBSO with a copy of the notice given by the BBDR applicant to the Market Participant for the Load Facility (Please refer to Appendix 1);
2. Unanimously approved proposed amendment #2, “Ancillary Services Provided directly to NBSO by Loads that are on Standard Service”; and
3. Unanimously approved proposed amendment #3, “Purchases from External Markets as External Dispatchable Facilities” subject to revisions to clarify the wording with respect to the Facility Owner in section 2.6.3A (Please refer to Appendix 2).

On the basis of the foregoing, the Market Advisory Committee recommends the adoption and implementation of proposals #1 and #3 above, as amended, and proposal #2 above, as drafted.
